RemindMyCustomers.com (the “Site”) is owned and operated by Text Services, LLC (“Text Services,” “we,” “us,” or “our”), a Mississippi limited liability company. By accessing our Site or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these terms, please do not use our Site or Services.
2. Permitted and Prohibited Uses
You agree to use RemindMyCustomers.com only for lawful purposes and in accordance with these Terms of Use. You may not use the Site or Services for any purpose that is unlawful, abusive, or otherwise prohibited, including but not limited to:
• Sending unsolicited phone calls, text messages, or emails (sometimes called “spam”)
• Disrupting the RemindMyCustomers.com system or interfering with other customers’ use of the Service
• Transmitting content that violates any law, court order, or regulation
• Transmitting content that is offensive, harassing, or likely to be unwelcome to recipients
• Damaging RemindMyCustomers.com property or infrastructure
• Interfering with our ability to provide service to other users
You are responsible for ensuring that all contacts in your lists have consented to receive messages in accordance with applicable law, including the Telephone Consumer Protection Act (TCPA).
3. Content Responsibility
You are solely responsible for all content you transmit through the RemindMyCustomers.com platform, including the accuracy, legality, and appropriateness of all messages sent. Text Services, LLC provides the Service of sending text messages, phone calls, and emails on your behalf and is not liable for any consequences that may arise from the content of communications sent through our platform.
4. Multiple Locations
If your business has multiple locations, each location must establish its own RemindMyCustomers.com account. A single account cannot be used for more than one location, and each location will be billed separately. When multiple businesses share the same office or administrative staff, each business must maintain its own separate account for the system to function properly.
5. Limitation of Liability
Under no circumstances will Text Services, LLC be liable to you or any other person for any indirect, direct, special, punitive, incidental, or consequential damages of any character arising from your use of, or inability to use, our Services.
While phone calls, text messages, and emails are delivered promptly in the vast majority of cases, Text Services, LLC does not guarantee 100% delivery. Many factors outside our control — including carrier routing, network conditions, and device availability — can affect delivery. We are not liable for messages that are not delivered or that are delayed. By using our Service, you acknowledge and agree to this limitation.
6. Termination and Cancellation
Cancellation by you: You may cancel your RemindMyCustomers.com account at any time without penalty. If cancellation occurs within the 30-day money-back guarantee period, you are eligible for a full refund. After that period, no refunds will be issued and the service will simply end. You may be charged for any outstanding usage incurred prior to cancellation.
Termination by us: Text Services, LLC reserves the right to terminate any account at any time, without notice, for any reason we deem appropriate. Grounds for immediate termination without refund include, but are not limited to: sending adult-oriented content, failing to honor opt-out requests, spamming, or any other violation of these Terms of Use.
If we terminate your account for reasons other than a violation of these Terms, any service fees paid in advance will be prorated and refunded for the unused portion of the service period.
7. Opt-Out Compliance
You must honor all opt-out requests promptly. End users may opt out of receiving messages at any time by replying STOP to any message, or by using the opt-out link at RemindMyCustomers.com. Failure to honor opt-out requests is a violation of these Terms and may result in immediate account termination.
8. Intellectual Property
All content, design, code, concepts, and other materials associated with RemindMyCustomers.com and Text Services, LLC are protected by intellectual property law. By using our Service, you agree not to duplicate, copy, replicate, or “copycatt” any part of our platform, program, style, or ideas without express written permission from Text Services, LLC. We reserve the right to enforce our intellectual property rights at any time.
9. Policy Updates
We may update these Terms of Use from time to time to reflect changes in our practices, legal requirements, or other factors. When we make changes, we will update the “Effective Date” at the top of this page and post the revised terms on our Site. We will also notify registered users via email sent to the address on file for your account. Your continued use of our Site or Services after the effective date of any revised Terms constitutes your acceptance of the updated terms.
10. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions.
